Freedom of Information Act (FOIA)

The Freedom of Information Act (FOIA) is a Federal law that gives “any person,” including U.S. citizens, foreign nationals, organizations, associations, and universities the right to obtain information from a Federal Government Agency (codified at 5 U.S.C. Section 552). An attorney or other representative with proper authorization may make a FOIA request on behalf of “any person.” Also, a State or a State agency may make a FOIA request.
Our Freedom of Information Act Unit responds to requests for records or documents in the possession of the contractor. FOIA does not require us to create new records or documents. Only existing records or documents are covered by FOIA. If the requester is asking questions or requesting clarification, as opposed to documents, the request does not fall within the scope of FOIA.
How to Make a FOIA Request
All FOIA requests must:
- Be submitted in written form
- Contain a reasonable description of the record(s) needed
- Clearly indicate the name, address and telephone number of the requestor
- Be signed by the requestor (a faxed or e-mail signature is acceptable)
A request for a Medicare cost report should include the facility name, Medicare provider number, and the year-end of the cost report you are requesting.
If you are requesting medical records for someone other than yourself, you will need the person’s written consent to disclose them to you. A Medicare Authorization Form is available on the CMS website. If the individual signing the valid authorization is not the beneficiary, then you must include documentation supporting the authority of that person to sign on behalf of the beneficiary.

FOIA Request Timeline
All efforts are made to process FOIA requests within 20 working days from the date WPS GHA receives the request. However, some requests may take longer to process. In this situation, we will contact the requestor with a status on their request.
Charging of Fees for FOIA Requests
If the estimated cost of fulfilling a FOIA request is $250 or more, the Medicare Administrative Contractor (MAC) is required to collect the fee prior to completing the request. The requestor will be notified in writing of the estimated cost of the request. Please read the letter very carefully and follow the detailed instructions on remitting the amount due. Once the check has been received for advance payment, the request will be fulfilled. If the requestor does not respond within 30 days from the date of the letter, the FOIA request is considered closed.
If the total charges for the request are under $250, the MAC will bill the requestor at the time the request is fulfilled.
Release of Records for FOIA Requests
The MACs have been granted authority to release specific types of information to the requestors. If the requested records are not directly releasable by the MAC, we will forward the records to the appropriate CMS Regional Office for review and determination. In this case, CMS will send a final response to you.
